Seeking dismissal of Thapar’s bail plea, the agency said: “If bail is granted to Thapar, it might lead to stoppage of free flow of information and he might influence his employees which will result in hampering the investigation.” The agency has informed the court that the employees of the Avantha Group are being summoned for recording their statement in order to trace the utilisation of the earlier loans taken by the group companies which were settled through the loan of Yes Bank. The agency said it recorded the statement of an employee of the Avantha Group who purportedly claimed that though Thapar was the non- executive chairman of the Avantha Group, he was overseeing all the crucial financial decisions taken by it. The ED, in its reply opposing Thapar’s bail, said a “structure was devised by the officials of Avantha Group and Yes Bank to route the funds from one company to another group company to eventually pay off the existing loans from Edelweiss & Aditya Birla Finance”. Seeking bail for Thapar, his counsel Vijay Aggarwal argued that the law of bail is an extension of right to life and personal liberty as contained in Article 21 of the Constitution of India. The court will take up the case, for cognisance of the charge sheet, on October 4. In a related development, the agency filed its first charge sheet against Thapar. The Avantha Group received “the instant proceeds of crime” to settle the existing loans taken from Edelweiss and Aditya Birla Finance, the ED claimed. Also, the interest rate reduced from around 15% to 9%. This transaction provided relief to the Avantha Group, as it did not have to renew the existing loans at the end of every year.
